Where arrest is not required in the circumstances specified by the law, the police may direct the person to appear before the officer or at the place specified in the notice.

If a person complies with the notice and continues to comply, the law places restrictions on arrest for that offence, subject to the circumstances and requirements provided in Section 35.

In simple words:

Receiving a notice does not automatically mean that you are being arrested.

But it also does not mean that the notice should simply be ignored.

Therefore, two assumptions should be avoided:

❌ “I received a notice, so I can never be arrested.”

❌ “The police called me, so I will definitely be arrested.”

Neither conclusion can be drawn without examining the actual circumstances.

What If You Are Worried About Arrest?
